Studio and contact

These terms apply to photography services provided by Maria Kuny Photography, Altsagenstrasse 5, 6048 Horw, Switzerland. Contact: info@mariakuny.com, +41 78 820 98 08.

Bookings and session confirmation

A session date is confirmed only after Maria Kuny Photography has accepted the booking and the required reservation payment has been received. Availability shown or requested on the website is not a final booking until it has been personally confirmed.

For newborn sessions, the due date is used for planning. The final date is confirmed after the baby arrives, depending on availability and the baby's wellbeing.

Payments

Unless otherwise agreed in writing, sessions are paid in two instalments: 50% to reserve the date and the remaining 50% on the day of the session.

For the Maternity + Newborn collection, the discounted package price applies only when the collection is paid in full on the day of the maternity session.

Prices are shown in Swiss francs. Travel, permits, parking, location fees, special styling, or additional products may be charged separately when they apply.

Cancellations and rescheduling

If you need to reschedule, please contact Maria Kuny Photography as early as possible. A new date will be offered depending on availability.

If a session must be moved because of illness, pregnancy-related circumstances, the baby's arrival, unsafe weather for an outdoor session, or another reasonable reason, Maria Kuny Photography will work with you to find a suitable alternative date.

Reservation payments secure time in the calendar and may be non-refundable if a client cancels without rescheduling or does not attend the session. Any exception is handled at Maria Kuny Photography's discretion.

Session locations and timing

Sessions can take place in the studio in Horw, at home, or outdoors, depending on the selected session and prior agreement. Travel, permits, or location fees may apply.

The stated session duration is an approximate guide. Newborn sessions may include time for feeding, changing, soothing, and breaks. Arriving late may reduce the available session time.

Image selection, editing, and delivery

After the session, you receive a private online gallery to select the photographs included in your collection. Final images are professionally edited and delivered digitally after selection and retouching.

Extra images are CHF 25 each. Raw, unedited files are not provided. Fine art prints are part of each collection; declining them does not change the package price.

Delivery times can vary depending on season, workload, and the number of selected images. Maria Kuny Photography will communicate expected timing as clearly as possible.

Style and creative decisions

Clients book Maria Kuny Photography because of the photographic style, editing, posing, and artistic approach shown in the portfolio. Final creative decisions about lighting, composition, retouching, colour, black-and-white conversion, and image selection remain with Maria Kuny Photography.

The goal is always to create beautiful, timeless images, but exact poses, props, locations, weather, baby cooperation, child mood, or specific inspiration images cannot be guaranteed.

Client responsibilities

Clients are responsible for providing accurate contact details, arriving on time, communicating relevant health or safety information, supervising children, and following reasonable studio or location guidance.

For at-home or outdoor sessions, clients are responsible for access to the location and any permission required to photograph there, unless otherwise agreed.

Copyright and image use

Maria Kuny Photography retains copyright to all photographs. Clients receive a personal licence to use the purchased final images for private, non-commercial purposes, including printing, sharing with family, and posting on personal social media.

Images may not be sold, edited, filtered, entered into competitions, used for business or advertising purposes, or provided to third parties for commercial use without written permission.

Maria Kuny Photography may use session images for portfolio, website, social media, printed samples, model calls, marketing, and advertising unless the client informs Maria Kuny Photography in writing before or on the day of the session that the images must remain private. Images created as part of a model call may be used for publication and promotion according to the agreed model call terms.

Liability

Maria Kuny Photography works with care and professional equipment. Liability is limited to direct damages caused intentionally or by gross negligence, to the extent permitted by applicable law.

In the unlikely event of equipment failure, data loss, illness, accident, or another circumstance that prevents completion of the service, Maria Kuny Photography will offer a reasonable solution such as rescheduling, replacement delivery where possible, or refund of affected paid services.

Governing law

These terms are governed by Swiss law. The place of jurisdiction is Switzerland, subject to mandatory legal provisions.
